The immigration categories from which applicants can extend their stay in the UK into the post-study worker category are:
- student;
- student nurse;
- student re-sitting examinations;
- student writing up a thesis.
Those who are a participant in the Science and Engineering Graduates Scheme (SEGS), International Graduates Scheme (IGS) or Fresh Talent: Working in Scotland Scheme (FT: WISS) , will come under the transitional arrangements.
Students, who are given leave to remain (permission to stay) as a post-study worker, will be able to live and work in the United Kingdom for a maximum period of two years.
When the end of this period approaches they should be able to extend their leave further by switching into another point based system category such as Tier 1 General Migrant or Tier 2 Skilled Worker.
The conditions to be met for permission to stay for those already in the UK as student are as follows:
- they must have no recourse to public funds;
- they must register with the police if applicable;
- they may not be employed as a doctor in training (with the exception of those who have, or were last given, permission to enter or stay in the International Graduates Scheme (IGS), or Science and Engineering Graduates Scheme (SEGS), or Fresh Talent: Working in Scotland Scheme (FT:WISS).
Eligibility: How do I qualify?
To qualify under the post-study worker category, applicants must pass a points-based assessment.
To do so applicants must score:
- 75 points by showing that they have a United Kingdom qualification , obtained at a United Kingdom institution whilst in the UK as a student; and
- 10 points by showing that their English language abilities meet the UKBA's requirements; and
- 10 points by showing that they have enough funds to meet the UKBA's maintenance requirements: - Applicants, who do not score a minimum of 75 points for their attributes and 10 points for English language and 10 points for available maintenance, will not qualify.
Applicants must be able to support themselves for the entire duration of their stay in the UK without needing any help from public funds. In order to qualify under Tier 1 (Post-Study Work) applicants must be able to demonstrate that they have £800 for themselves and (where applicable) £533 for each dependant accompanying them. Applicants must have held these amounts for a minimum period of 3 months immediately preceding and dated no more than 1 month prior to the date they submit their application. The balance should not fall below the required minimum at any time during the 3 month period.
If the main applicant has been present in the United Kingdom for less 12 months or more, the main applicant or the family member of the post-study worker must have £1600 to support himself/herself.
Exemptions:
The requirements that applicants must meet to score points vary depending on whether they are:
- switching from student status (which includes students, student nurses, students re-sitting examinations, and students writing up a thesis) and applying for permission to enter or stay in the United Kingdom under the post-study worker category (initial applications); or
- currently have leave under the Science and Engineering Graduates Scheme (SEGS), International Graduates Scheme (IGS) or Fresh Talent: Working in Scotland Scheme (FT:WISS), and are applying to stay in the United Kingdom under the post-study worker category (transitional arrangements).

The transitional arrangements
The transitional arrangements will apply to those who are in the United Kingdom and their current or last grant of leave was under the:
- Science and Engineering Graduates Scheme (SEGS); or
- International Graduates Scheme (IGS); or
- Fresh Talent: Working in Scotland Scheme (FT: WISS).
If they were last given less than two years ' leave under the International Graduates Scheme or Science and Engineering Graduates Scheme, applicants will be able to apply under the transitional arrangements to extend their leave for any length of time which will bring their entire leave for a maximum of two years.
Applicants currently under the Fresh Talent: Working in Scotland Scheme, should have been given two years' leave to start with and as a result will not qualify to extend their leave further under PSW. |
