Child Born In The UK
If your child is born in the UK you will need to file an application for further leave to remain on his or her behalf. S/he will be granted leave to remain in line with your leave/visa. Your child should not
leave the UK until the process has been completed if s/he is to re-enter the UK without problems.
PROCESSING TIPS - FOR A FURTHER LEAVE TO REMAIN APPLICATION
- Ensure that you are using an up to date form;
- Ensure that your signature on the form matches your signature in your passport;
- Ensure that all relevant sections are duly completed and that you have gathered all the supporting documentation in line with the BIA's checklist;
- Ensure that your passport photos meet the BIA's requirements;
- If submitted by post or in person, make a copy of the supporting documents;
- Make sure that your application is filed before you travel abroad with your baby; the expiry of your current leave;
- The form should be completed in the name of your baby, but signed by one of the parents;
- The form should be submitted along with a letter signed by both parents confirming that they agree to their child being granted leave to remain in the UK;
- You will also need to submit your original marriage certificate along with your child birth certificate and your original passports – if you are submitting a letter of confirmation you might be able to get the application approved without having to submit your spouse passport – however we would strongly recommend that both passports be submitted to avoid disappointments.
