COMPLIANCE - WORKING IN THE UK WITHOUT A WORK PERMIT

The nationals of the following countries do not require a work permit to work in the UK: Austria, Belgium, Cyprus, Denmark, Finland, France, Germany, Greece, Holland, Iceland, Ireland, Italy, Liechtenstein, Luxembourg, Malta, Norway, Portugal, Spain, Sweden, Switzerland

The persons with the following immigration status do not require a work permit to work in the UK:

• Dependant spouses of persons settled in the UK, or of work permit holders, or of UK Ancestry visa holder
• Persons holding indefinite leave to remain in the United Kingdom
• Students studying full time in the UK can work maximum 20 hours per week during term time and full time during vacations
• Nationals of the “A8” Accession countries – see below
• UK Ancestry Visa Holders
• Working Holiday Visa Holders

The A8 Accession countries and the Worker Registration Scheme

Since 1st May 2004 most nationals of the new Member States (except Cyprus and Malta) working in the UK have had to register under the Accession State Worker Registration Scheme. The registration must be done if the employee intends to work for more than a month. The application must be filed within the first month of employment.

Once the individual has worked in the UK legally for a continuous period of 12 month, he will acquire full rights of free movement and will no longer be required to register.

Nationals of the following countries require to register:

• Czech Republic
• Estonia
• Hungary
• Latvia
• Lithuania
• Poland
• Slovakia
• Slovenia


TIPS:

The WRS application must be filed during the first month of employment.
Although the onus is on the employee to register, the employer will be non compliant and therefore opened to fines if they continue employing the foreign worker who has not been issued a worker registration card after the first month of employment.
